A proposed OTR convenience store and service station in Heathfield will go ahead, despite ongoing objections from locals.
Adelaide Hills Council initially knocked the planning application on the head after receiving a record number of objections – but that was overturned when the developer appealed to the Environment, Resources and Development Court.
The council’s now decided it’s not in the community’s interests to continue the fight, releasing its reasoning via a statement yesterday:
“In reaching its decision, the Council Assessment Panel (CAP) considered the risks associated with further litigation, the broader public interest, the financial impact on Council and the community of continued legal proceedings, and the reduced impact of the revised proposal considered at the Environment, Resources and Development Court hearing.”
“It is also acknowledged that additional conditions suggested by the CAP were successfully imposed by the ERD Court that will govern daily operational matters and address a range of community concerns and development impacts.”
“The CAP acknowledges the strong community interest in this matter and thanks those who have participated throughout the planning process.”
